Butler County man alleges insurance company denied claim based on insufficient investigation

CAPE GIRARDEAU — A Butler County man is suing Guarantee Trust Life Insurance Co., citing alleged breach of contract.

Thomas W. Grisham filed a complaint in the U.S. District Court for the Eastern District of Missouri against the insurance company alleging that it breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on March 2, 2015, he sustained damages, including hospital and cancer treatment expenses, caused by defendant's wrongful denial of benefits under her policy, which entitled the plaintiff to receive certain cancer coverage benefits. However, the defendant was purported to void the policy from its inception. The plaintiff holds Guarantee Trust Life Insurance Co. responsible because it allegedly failed to fairly pay benefits for valid claims made by the insured and denied coverage based on a wholly inadequate and insufficient claim investigation.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount of $206,100, plus attorney’s fees, costs, interest and further relief that the court deems just. He is represented by Robert L. Brady of Brown & James PC in St. Louis.
