ST. LOUIS — A St. Charles leasing company is suing Musket Corp., citing alleged breach of contract.
American Railcar Leasing LLC filed a complaint in the U.S. District Court for the Eastern District of Missouri against Musket Corp. alleging that the logistics company breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that in August 2016, it suffered damages, including costs of repair, inability to lease the tank cars or sell them in good condition, upon discovering that all 98 tank cars that the plaintiff leased to the defendant were damaged with corrosion. The complaint alleges that the defendant transported a highly corrosive form of crude oil, but despite repeated demands by plaintiff for defendant to remedy and repair the damages, it continued to ignore plaintiff's appeal.
The plaintiff holds Musket Corp. responsible because it allegedly failed and refused to assume responsibility for the damages it caused, despite its agreement that the tank cars were suffering from corrosion and against the leasing contract in which the defendant agreed to preserve and return the cars in good condition.
The plaintiff seeks judgment against the defendant, pay for damages to the tank cars, interest and further relief as the court deems just. The company is represented by Andrew J.
