Pension fund trustees say S&C Concrete failed to make contributions

ST. LOUIS — Trustees of pension and welfare funds are suing S&C Concrete LLC, citing alleged breach of contract.

Construction Industry Laborers Pension Fund, Patrick R. Pryor, Steve Schrimpf, Construction Industry Laborers Welfare Fund, Perri L. Pryor and Steven C. Glenn filed a complaint in the U.S. District Court for the Eastern District of Missouri against the construction company alleging that the employer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that they have suffered monetary losses from the defendant's underpayment of contributions and erroneous remittance reports, as required by the collective bargaining agreement to which both parties entered into. The plaintiffs hold S&C Concrete responsible because it allegedly failed to fulfill its obligations under the agreement by failing to pay the required contributions and failed to furnish plaintiff with accurate remittance reports.

The plaintiffs seek judgment against the defendant, $790.24 and $212.35 for underpaid contributions, $4,118.40 and $6,069.10 in unpaid fringe benefit contributions, $4,118.40 for liquidated damages and interest, $289.35 for interest, $1,213.82 for liquidated damages, an account of the defendant's books and records, attorneys' fees, costs incurred and other relief as the court may deem appropriate.
