ST. LOUIS — A financing company is suing guarantors of a car dealership that has since closed, citing alleged breach of contract.
Ford Motor Credit Co. LLC filed a complaint in the U.S. District Court for the Eastern District of Missouri against Randal Blount, Barbara Blount and Edward Blount, alleging that they breached their duties of good faith and fair dealing.
According to the complaint, the plaintiff alleges that in 2008, it suffered substantial monetary losses when Ferguson-based Randy Blount Automotive Group had financial difficulties and was unable to pay its debts to the plaintiff. After the dealership's assets were sold and the proceeds were applied to the debt, the defendants refused to pay the deficiency, as required by their guaranties. The plaintiff holds the defendants responsible because the defendants allegedly failed to assume responsibility to pay amounts owed under loan guaranties.
The plaintiff requests a trial by jury and seeks judgment against defendants for $1,360,701.91 and $221,220.56 plus interest per diem, costs, expenses, attorneys’ fees and further relief as the court may deem just.
