St. Louis woman says Liberty Life Assurance failed to review medical records when denying benefits

ST. LOUIS — A St. Louis woman is suing Liberty Life Assurance Co. of Boston, citing alleged breach of contract.

Felicia Peach filed a complaint in the U.S. District Court for the Eastern District of Missouri against Liberty Life Assurance Co. of Boston alleging that the plan administrator violated Employee Retirement Income Security Act (ERISA) through non-payment of plan benefits.

According to the complaint, the plaintiff alleges that she suffered from a loss of disability benefits resulting from the defendant's denial of her claim for long-term disability benefits. This was despite testament from her treating physician of her autoimmune diseases and blood disorders, which rendered her disabled. The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly failed to make disability benefit payments to the plaintiff, failed to consider the plaintiff's medical records and clear opinions of her physicians and failed to discharge its duties in respect to claims processing in the interests of plaintiff.

The plaintiff seeks damages against the defendant, payment of disability benefits, damages, interest and further relief as the court deems just. She is represented by Matthew R. Davis of Gallagher Davis in St. Louis.
