Medical assistants say St. Louis Urgent Cares failed to pay overtime

ST. LOUIS — Two medical assistants have filed a class-action lawsuit against an urgent care center with locations throughout St. Louis, citing alleged violation of the Fair Labor Standards Act (FLSA).

Toria Anderson and Wendy Medina filed a complaint on behalf of individually and on behalf of others similarly situated on Dec. 22, in the U.S. District Court for the Eastern District of Missouri against Creve Coeur Urgent Care LLC; Downtown Urgent Care LLC; Eureka Clinic LLC; North City Urgent Care LLC; UCSL LLC, d/b/a St. Louis Urgent Cares; and Sonny Saggar, alleging that they failed to provide proper wages and benefits.

According to the complaint, the plaintiffs allege that they and other medical assistants have suffered loss of earnings for working over 40 hours per week, but were not paid promised weekend incentive and proper overtime wages by the defendant at the statutory rate of one and a half times their regular rate.

The plaintiffs hold the defendants responsible because they allegedly failed to pay the promised additional rate for weekend shifts, failed to compensate its employees of proper overtime wages and failed to pay collective members for time spent working after clocking out.

The plaintiffs request a trial by jury and seek judgment against the defendants, certify case as a collective action, declaratory relief, attorneys’ fees, costs, full amount of damages, liquidated damages, interest and further relief as the court deems appropriate.
