ST. LOUIS — Graham, Texas, residents are suing General Motors LLC, a manufacturer, citing alleged liability and negligence.
Kenneth Weimer, Christopher Daily, Alice Haupt, Irma Barrett, Devin Wright and Traci Wright filed a complaint in the U.S. District Court for the Eastern District of Missouri against General Motors alleging that the manufacturer obtained profit through unfair or deceptive trade or commerce.
According to the complaint, the plaintiffs allege that on March 6, 2015, Weimer, decedent of Daily, and minor children of other plaintiffs, were passengers in a 1999 Chevrolet Express van, which was manufactured in Wentzville, driven by Weimer. The plaintiffs have suffered extreme emotional distress, mental anguish, impairment, disfigurement, loss of consortium, funeral and burial expenses as a result of the fatal injuries to Daily's wife, Stacey Daily, and physical injuries suffered by plaintiffs' minor children due to a crash. According to the complaint, the vehicle failed to protect them because it violated several crashworthiness principles that could have prevented serious injuries and fatality. All occupants were properly seated and restrained, the complaint states.
The plaintiffs hold General Motors responsible because the defendant allegedly failed to properly test the vehicle for its handling, stability and control, failed to provide proper restraint and failed to warn consumers of the potential risks, hazards and/or dangers of the vehicle.
The plaintiffs seek judgment against defendant, actual damages, interest, costs of suit, other relief to which plaintiffs are entitled to. They are represented by E. Todd Tracy, Stewart D.
