Labor organizations accuse Ford Marble and Tile Inc. of violating ERISA

ST. LOUIS — Labor organizations are suing Ford Marble and Tile Inc., citing alleged violation of Employee Retirement Income Security Act (ERISA).

The Carpenters’ Pension Trust Fund of St. Louis, St. Louis-Kansas City Carpenters Regional Council et. al. filed a complaint on Feb. 14 in the U.S. District Court for the Eastern District of Missouri against Ford Marble and Tile alleging that the Illinois corporation breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that they have suffered damages from the defendant's failure and refusal to make all obligated contributions to the funds and to forward to the union all the deducted dues, to which the plaintiffs demanded payment to no avail. The plaintiffs hold Ford Marble and Tile responsible because the defendant allegedly failed to fulfill its obligations to pay the required contributions and permit an audit of records under the collective bargaining agreement and caused the plaintiffs to retail and pay for legal counsel.

The plaintiffs seek judgment in favor of plaintiffs, payment of delinquent contributions, plus liquidated damages and interest, submit its books and records for an audit and accounting, attorneys' fees, costs, submit the required monthly statements, and further relief as the court may deem just. They are represented by Greg A. Campbell of Hammond and Shinners PC in St. Louis.
