St. Francois County says former employer discriminated against her

ST. LOUIS — A St. Francois County woman is suing her former employer, citing alleged discrimination and failure to uphold Americans with Disabilities Act regulations.

Lindy Ward filed a complaint on Feb. 14 in the U.S. District Court for the Eastern District of Missouri against Midwest Imaging Center LLC, Richard Friend and Julie Krause alleging that they breached their duties of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on Jan. 27, 2016, she was discharged from employment by the defendants on pretext of demotion and transfer to cover discrimination and retaliation on the plaintiff's cancer diagnosis, which required her to attend additional treatment twice weekly. This allegedly prompted defendants to demote and discharge the plaintiff, who suffered from lost wages and benefits and embarrassment as a result of defendant's conduct. The plaintiff holds the defendants responsible because they allegedly showed reckless indifference to the plaintiff’s protected rights and retaliated against her by demotion and constructive discharge.

The plaintiff seeks judgment in her favor, losses or damages including back pay, benefits of employment and front pay, punitive damages, costs of action, attorneys' fees and additional relief as may appear to the court to be equitable.
