ST. LOUIS — A logistics company is suing Schnuck Markets Inc., citing alleged breach of contract and unjust enrichment.
Jacobson Warehouse Co. Inc., d/b/a XPO Logistics Supply Chain, filed a complaint on Feb. 17 in the U.S. District Court for the Eastern District of Missouri against Schnuck Markets alleging that the chain of retail stores breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that, on May 1, 2015, it suffered substantial damages upon entering an agreement with the defendant to manage the storage facility for the defendant's chain of grocery stores because the defendant failed to fulfill its part of the agreement to prepare the warehouse for operations on or about July 1, 2016. The plaintiff was further damaged from the defendant's non-payment of warehousing fee. The plaintiff holds Schnuck Markets responsible because the defendant allegedly failed to adequately prepare the facility with the necessary equipment and furnishings, failed to provide necessary information and cooperate with plaintiff in the management and operation of the facility and wrongfully withheld payment of warehousing fee without justification.
The plaintiff seeks judgment in its favor, warehousing fees of approximately $1,317,428.12, interest, costs of suit, attorneys' fees and further relief as the court deems just. The company is represented by Lawrence C. Friedman and Mark A. Mattingly of Thompson Coburn LLP in St. Louis.
