ST. LOUIS — A St. Peters woman is suing Denny's Inc. citing alleged failure to warn, insufficient measures were taken to prevent injuries and negligence.
Sherri Jenkins filed a complaint on Feb. 17 in the U.S. District Court for the Eastern District of Missouri against Denny's Inc. alleging that the restaurant failed to provide a reasonably safe environment for its customers.
According to the complaint, the plaintiff alleges that on Dec. 25, she slipped on a foreign substance that had accumulated on the floor of defendant's St. Peters location. She sustained multiple bodily injuries, disability, pain and suffering, medical expenses and lost wages as a result of defendant's negligent conduct of creating or allowing a dangerous condition to exists. The plaintiff holds Denny's responsible because the defendant allegedly failed to manage, inspect, clean and maintain its premises in a safe condition; failed to provide a safe ingress and egress in the premises; and failed to warn plaintiff of the dangerous condition of the premises.
The plaintiff seeks judgment against defendant, award in excess of $75,000 plus costs of suit. She is represented by Thomas C. Rich, Kristina D. Cooksey and Michelle M. Rich of Rich, Rich & Cooksey PC in Fairview Heights, Illinois.
