Consumer accuses debt collectors of unfair conduct

ST. LOUIS — A Lincoln County man is suing debt collectors, alleging unfair collection conduct.

Brian K Betts filed a complaint Feb. 27 in U.S. District Court for the Eastern District of Missouri against Midland Funding LLC and Does 1-4, alleging violation of the Fair Debt Collections Practices Act.

According to the complaint, in Sept. 24, 2015, Betts satisfied his alleged debt. In August 2016, the suit says, he reviewed his credit report and found out Midland Funding continued to report his credit card debt at issue as a negative collection item.

The lawsuit states the report still listed the original balance of $7,783. As a result, Betts he says has suffered damages to the detriment of his credit score and/or creditworthiness. 

The plaintiff alleges the allegedly refused to cease reporting the debt as an open, negative collection item on his credit report and furnished it to one or more national credit bureaus.

Betts seeks trial by jury, statutory, punitive and actual damages, attorney fees and court costs, pre- and post- judgment interest and all further proper relief. He is represented by attorney Nathan D. Sturycz of Edwardsville, Illinois.
