Homeowners accuse Bank of America of inaccurate reporting

ST. LOUIS — Imperial homeowners are suing Bank of America, citing alleged inaccurate reporting.

Marsha Zotta and Greg Zotta filed a complaint on March 2, in the U.S. District Court for the Eastern District of Missouri against Bank of America NA alleging that the mortgage servicer violated the provisions of the Fair Credit Reporting Act.

According to the complaint, the plaintiffs allege that on April 8, 2015, the defendant furnished credit information to credit reporting agencies that they were delinquent with mortgage payments in 2010 and 2011. As a result, plaintiffs sustained severe emotional distress and lost of credit opportunities. The plaintiffs holds Bank of America responsible because the defendant allegedly falsely reported that they were delinquent with mortgage payments, negligently failed to conduct a reasonable investigation and failed to report that the information was incomplete and inaccurate.

The plaintiffs request a trial by jury and seek judgment against defendant in such sum as is just and reasonable, plus punitive damages, interest, attorney's fees and costs expended for this action. They are represented by Blair K. Drazic of Drazic Law Firm in Grand Junction, Colorado.
