Cornerstone Masonry failed to pay required fringe benefit contributions

ST. LOUIS — Employee benefit plan representatives are suing Cornerstone Masonry Inc., citing alleged breach of collective bargaining agreement.

Bricklayers’ Local Union No. 1 of Missouri Welfare Trust, Masonry Institute of St. Louis, et al filed a complaint on March 2 in the U.S. District Court for the Eastern District of Missouri against Cornerstone Masonry alleging that the Missouri corporation violated the Employee Retirement Income Security Act and the Labor Management Relations Act.

According to the complaint, the plaintiffs allege that as a result of the defendant's actions, the plaintiffs are unable to determine the full amounts of fringe benefit stamps purchased or the fringe benefit contributions paid by the defendant. The plaintiffs hold Cornerstone Masonry responsible because the defendant allegedly failed to purchase the required fringe benefit stamps or otherwise pay the required fringe benefit contributions and failed to submit monthly report forms.

The plaintiffs seek recovery of delinquent contributions, plus interest and liquidated damages, costs, accounting fees, attorneys’ fees and such other and further relief. They are represented by Greg A. Campbell of Hammond and Shinners PC in St. Louis.
