ST. LOUIS — Trustees are suing Green Trac LLC, citing alleged breach of contract.
Greater St. Louis Construction Laborers Welfare Fund, Construction Laborers Pension Trust of Greater St. Louis, et al. filed a complaint on March 3 in the U.S. District Court for the Eastern District of Missouri against Green Trac LLC alleging that the employer breached its duty of good faith and fair dealing.
According to the complaint, the plaintiffs allege that they have suffered damages from the defendant's refusal to submit to a financial examination of its books and records as agreed upon under the collective bargaining agreement, which further harm plaintiffs by not being able to determine adequate amount owed to plaintiffs. The plaintiffs hold Green Trac responsible because the defendant allegedly did not fulfill its obligations under the agreement by failing to pay adequate contributions and interest and not permitting an audit of its books and records.
The plaintiffs seek judgment against defendant, order an accounting of its books and records, contributions, liquidated damages, interest, attorneys' fees, accounting fees, costs, and further relief as the court may consider appropriate.
