St. Louis man says Gamache & Myers deceived him into signing judgment

Late 07

ST. LOUIS — A St. Louis man is suing Gamache & Myers PC, citing alleged violation of the Fair Debt Collections Practices Act (FDCPA).

Corey Curtis filed a complaint on March 3 in the U.S. District Court for the Eastern District of Missouri against Gamache & Myers alleging that the debt collector violated FDCPA through abusive, deceptive and unfair debt collection practices.

According to the complaint, the plaintiff alleges that on Aug. 16, he suffered shame, humiliation, anger, anxiety, emotional distress, fear, frustration and embarrassment from being deceived by the defendant to sign a consent judgment instead of a payment plan. Additionally, the defendant then demanded monthly payment of $65 instead of the agreed upon amount of $50. The plaintiff holds Gamache & Myers responsible because the defendant allegedly convinced the plaintiff to sign a consent judgment and disclosed the existence of the alleged debt to a third party without consent from the plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant, statutory damages of $1,000, actual damages, costs, attorneys’ fees, interest and further relief as deemed proper. He is represented by Nathan D. Sturycz of Law Office of Nathan D. Sturycz in Edwardsville.
