Policy holder accuses Aetna of violating contract

ST. LOUIS — A St. Louis woman is suing Aetna, alleging breach of contract, and violation of the Employee Income Security Act or ERISA.

Donna Green filed a complaint March 7 in U.S. District Court for the Eastern District of Missouri against Aetna Life Insurance Company and Home Depot USA Inc., alleging they breached their duties of good faith and fair dealing.

According to the complaint, since June 2, 2015, Green has suffered damages from a wrongful decision by the defendants to deny further disability benefits to her, despite evidence of medical records and lab results, and confirmation from her attending physician that Green suffers from fibromyalgia, and symptoms of psychosis, including hallucinations and paranoia. 

The plaintiff alleges the defendants failed to consider the substantial evidence of Green's disability and failed to make disability benefit payments and send notice of its claim decision.

Green seeks trial by jury, all benefits due, declaratory relief, restitution, costs of suit, attorney fees, and all relief the court deems just. She is represented by attorney Matthew R. Davis of Gallagher Davis LLP in St. Louis.
