HANNIBAL — A technician has filed a class action lawsuit against a Macon company, alleging violation of the Fair Labor Standards Act (FLSA).
Dewayne Coleman filed a complaint, on behalf of himself and of all others similarly situated March 9 in U.S. District Court for the Eastern District of Missouri Northern Division against OnShore Technology Services Inc., alleging failure to pay employees for all hours worked at the correct rate.
According to the complaint, Coleman and other exempt employees or those employed as quality assurance technicians have suffered lost earnings for working additional hours in excess of 40 per week. The suit says they were mis-classified by OnShore as exempt employees to avoid paying overtime wages at the statutory rate of one and a half their regular rate of pay as required by FLSA.
The plaintiff alleges OnShore Technology failed to pay Coleman overtime compensation, failed to maintain proper time records of all hours worked, and failed to post informational posters as required by law advising its employees of their rights under FLSA.
Coleman seeks trial by jury, liquidated damages, declaratory relief, attorney fees, costs, interest and all just relief. He is represented by attorneys Phillip M. Murphy II of Law Office of Phillip M. Murphy II in Kansas City, Missouri, and by Carlos V. Leach of Morgan & Morgan PA in Atlanta.
