ST. LOUIS — Trustees are suing a home improvement company, citing alleged violation of the Employee Retirement Income Security Act (ERISA).
Greater St. Louis Construction Laborers Welfare Fund, St. Louis Vacation Fund – Vacation Plan, et al. filed a complaint on March 8 in the U.S. District Court for the Eastern District of Missouri against Donald Bruce Walls, d/b/a Walls Concrete Design, alleging that the employer violated ERISA through non-payment of plan benefits.
According to the complaint, the plaintiffs allege that they have suffered monetary damages from defendant's unlawful practices, such as delinquent payment of contributions, not submitting its monthly report forms on time, and not maintaining a surety bond as required by the collective bargaining agreement. The plaintiffs hold the defendant responsible because the company allegedly failed to submit reports and contributions on certain months and failed to furnish evidence of surety bond to the plaintiffs.
The plaintiffs seek judgment against defendant, interlocutory order, $2,127.23 in liquidated damages, unpaid contributions, interest, costs, accounting fees, attorneys' fees and further relief as the court may consider appropriate.
