St. Louis woman alleges Preferred Staffing paid 'comp time' instead of overtime

ST. LOUIS — A St. Louis woman has filed a class-action lawsuit against her former employer, citing alleged violation of workers' compensation acts.

Regina Rulo-Speed filed a complaint individually and on behalf of others similarly situated on March 8, in the U.S. District Court for the Eastern District of Missouri against PS Employment LLC, d/b/a Preferred Staffing; Karen Poole; and American Employer Group VI Inc., alleging that they failed to provide employees their proper wages and benefits.

According to the complaint, the plaintiffs allege that they have suffered damages as a result of defendants' unlawful practice of misclassifying their employees to avoid paying for overtime wages. Plaintiffs routinely worked over 40 hours per week while scheduled by the defendants as “on-call” employees. Instead of being paid one and a half times the hourly wages for time worked over 40 hours, the plaintiffs were given "comp time." The plaintiffs hold the defendants responsible because the defendants allegedly misclassified plaintiffs in direct violation of the labor code, failed to compensate plaintiffs for all hours worked and failed to provide plaintiffs with compliant and accurate itemized wage statements.

The plaintiffs request a trial by jury and seek relief and judgment against defendants, unpaid overtime wages, determination of FLSA violations, liquidated damages, interest, attorneys’ fees and costs and further relief as the court deems fair.
