Academy Ltd. allegedly sent unauthorized text messages in violation of TCPA

ST. LOUIS — Individuals have filed a class-action lawsuit against a telemarketer, citing alleged violation of telephone harassment statutes.

Joe Kosulandich filed a complaint on behalf of himself and others similarly situated on March 8 in the U.S. District Court for the Eastern District of Missouri against Academy Ltd. and Academy Managing Co. LLC, alleging that they violated the Telephone Consumer Protection Act (TCPA) through intrusive and unwanted  texts.

According to the complaint, the plaintiffs allege that they have suffered from abuse and harassment, including invasion of their privacy and intrusion on their seclusion, because of the defendants' transmission of unsolicited text messages to advertise their goods and services. The plaintiffs hold Academy Ltd. and Academy Managing Co. LLC responsible because the defendants allegedly sent texts to recipients with such frequency meant to abuse or harass, unlawfully utilized an autodialer and contacted recipients without prior express consent.

The plaintiffs request a trial by jury and an order certifying the class, actual and statutory damages, an injunction requiring the defendants cease all wireless spam activities, attorneys’ fees and costs and other relief the court deems reasonable.
