Gleeson Asphalt failed to make contributions, lawsuit alleges

ST. LOUIS — Labor organizations are suing Gleeson Asphalt Inc., citing alleged violation of Employee Retirement Income Security Act (ERISA).

Greater St. Louis Construction Laborers Welfare Fund, Construction Laborers Pension Trust of Greater St. Louis, St. Louis Vacation Fund – Vacation Plan, et al. filed a complaint on March 8 in the U.S. District Court for the Eastern District of Missouri against the defendant, alleging that it breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that they have suffered economic damages from the defendant's failure to fulfill its obligations under the collective bargaining agreement. It failed to pay all amounts owed on certain months and did not provide its monthly reports in a timely manner, the complaint states The plaintiffs hold Gleeson Asphalt responsible because the defendant allegedly failed to fulfill its obligations under the agreement by failing to make required contributions and not permitting an audit of its records to determine final amount owed.

The plaintiffs seeks an interlocutory order, $169.54 in contributions and $ 2,902.93 in liquidated damages, interest, costs, accounting fees, attorneys' fees, the defendant to obtain the required surety bond or letter of credit and further relief as the court may consider appropriate.
