Hillsboro resident accuses The Law Offices of Jay B. Umansky PC of abusive collection practices

ST. LOUIS — A Hillsboro consumer has filed a class-action lawsuit against The Law Offices of Jay B. Umansky PC, citing alleged deceptive and unfair collection practices.

David Dunn Sr., individual and on behalf all others similarly situated filed a complaint on March 31, in the U.S. District Court for the Eastern District of Missouri against The Law Offices of Jay B. Umansky alleging that the debt collector violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Jan. 4, he received a collection letter from the defendant without advising the plaintiff that the defendant is only obligated to obtain verification of the debt if the plaintiff notifies the defendant of the dispute in writing. The plaintiff holds The Law Offices of Jay B. Umansky responsible because the defendant allegedly failed to comply with the validation of debt requirements in its initial communication.

The plaintiff requests a trial by jury and seeks actual and statutory damages, attorneys’ fees, costs and such other and further relief as the court may deem just and equitable. He is represented by Richard D. Dvorak of Dvorak Law, Chartered in Overland Park, Kansas.
