Man accuses The Lincoln National Life Insurance of breaching contract by not paying benefits

ST. LOUIS — A beneficiary is suing an insurer, citing alleged refusal to pay claims.

The Irrevocable Insurance Trust of June Ellen Kilo, by and through its trustee John A. Kilo, filed a complaint July 21 in the St. Louis Circuit Court against The Lincoln National Life Insurance Co., alleging the insurer failed to fulfill its obligations under the terms of an insurance contract.

According to the complaint, after the death of June Kilo on May 21, 2015, John Kilo made a claim and complied with all the terms and conditions of the insurance policy. To date, the plaintiff alleges he has not received payments for the insurance benefits in the amount of $500,000. The plaintiff holds The Lincoln National Life Insurance responsible because the defendant allegedly failed to settle death benefits proceeds to the plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant for death benefits payable in the amount of $500,000, costs of this suit and other relief. He is represented by Robert E. Trame and Timothy W. Callahan of Kilo, Flynn, Billingsley, Trame & Brown PC in St. Louis.
