Flooring, painting companies claim they weren't fully paid for work at Preservation Square Apartments

ST. LOUIS — Materials suppliers are suing various entities, citing alleged breach of contract.

United Carpet Co. Inc. and United Painting Inc. filed a complaint in the St. Louis Circuit Court against O'Fallon Place Limited Partnership 1A, 1B, Pase II and Phase III; Gresham Investment Corp.; Secretary of Housing and Urban Development, et al, alleging they failed to fulfill their obligations under a contract.

According to the complaint, the plaintiffs allege they provided materials and services for construction and improvements to Preservation Square Apartments in St. Louis. After allowance, credits and setoffs, the balance of $168,979.93 remains unpaid, the complaint states. The plaintiffs hold the defendants responsible because the defendants allegedly failed to make payment for the amount herein mentioned.

The plaintiffs request a trial by jury and seek judgment against defendants in the principal amount of $168,979.93, plus interest, attorney' fees, costs of suit and lien and such other just and proper relief. They are represented by David L. Smith and Timothy M. Bosslet of Kramer & Frank PC in St. Louis.
