Mother alleges St. Louis property owners failed to repair peeling lead-based paint

ST. LOUIS — A minor child and mother are suing property owners, citing alleged insufficient measures were taken to prevent injuries.

Jaxsen Calmese, an infant, by his mother Kortney Calmese, filed a complaint July 20 in the St. Louis 22nd Judicial Circuit Court against Mark Vlaich and Carolyn Vlaich and Diamond Star Management Corp., alleging they breached their duties to maintain a property in a reasonably safe and sanitary condition.

According to the complaint, Jaxsen Calmese was exposed to, inhaled and/or ingested lead-based paint or paint dust. He allegedly suffered from lead poisoning, which resulted in severe and irreparable injuries to his body, brain and nervous system. The plaintiff holds Mark Vlaich and Carolyn Vlaich and Diamond Star Management responsible because the defendants allegedly neglected to repair the peeling, chipped and deteriorated paint condition of the home and failed to properly and timely abate the premises.

The plaintiff requests a trial by jury and seeks judgment against defendants in excess of $25,000, costs of this suit and such other just and equitable relief. He is represented by Amy Collignon Gunn and Elizabeth S. Washam of The Simon Law Firm PC in St. Louis.
