ST. LOUIS — A garden center employee is suing an herbicide manufacturer and distributor, citing alleged false advertising.

Richard Miller filed a complaint in the U.S. District Court for the Eastern District of Missouri against Monsanto Co. and John Does 1-50, alleging they failed to ensure that Roundup will not cause harm to users.

According to the complaint, the plaintiff alleges that during his employment at a garden center, he was exposed to Roundup, which contains active ingredient glyphosate and surfactant POEA. As a result, he developed non-Hodgkin’s lymphoma, a cancer of the lymphatic system. The plaintiff holds the defendants because the defendant allegedly negligently manufactured and distributed Roundup with full knowledge that it was dangerous and defective and failed to provide adequate warnings and proper directions about the dangers associated with using it.

The plaintiff requests a trial by jury and seeks compensatory, punitive and economic damages, pre- and post-judgment interest, attorneys’ fees, costs and such other just and proper relief. He is represented by Eric D. Holland of Holland Law Firm in St. Louis and Jessica L. Richman of Parker Waichman LLP in Port Washington, New York.
