Chief underwriter sues Berkadia Commercial Mortgage

ST. LOUIS — A chief underwriter is suing a commercial lender, citing alleged retaliation and wrongful termination.

Richard Sherman filed a complaint on July 31, in the U.S. District Court for the Eastern District of Missouri Eastern Division against Berkadia Commercial Mortgage LLC, alleging that the commercial lender violated the False Claims Act and the public policy.

According to the complaint, the plaintiff alleges that on Oct. 13, he was terminated from his employment. As a result, he has sustained damages for lost wages, bonuses and benefits and suffered from emotional distress. The plaintiff holds Berkadia Commercial Mortgage responsible because the defendant allegedly retaliated against him and terminated his employment for preventing the defendant from committing violations of the National Housing Act, Housing & Urban Development Department rules and regulations and/or the False Claims Act.

The plaintiff requests a trial by jury and seeks actual and compensatory damages, reinstatement, pre- and post-judgment interest, costs of suit and all other relief as the court deems just and proper. He is represented by Russell C. Riggan and Samuel W. Moore of Riggan Law Firm LLC in Kirkwood.
