ST. LOUIS — A consumer is suing the maker of Roundup, citing alleged design and manufacturing defect.

Anthony Pearce filed a complaint Sept. 1 in the U.S. District Court for the Eastern District of Missouri against Monsanto Co., alleging it breached its duty to exercise reasonable care to ensure Roundup would not cause dangerous side effects.

According to the complaint, the plaintiff alleges that as a result of using and exposure to defendant's Roundup, which contains active ingredient glyphosate and surfactant polyoxyethylene tallow amine, he developed non-Hodgkin lymphoma and has incurred significant economic and noneconomic damages.

The plaintiff holds Monsanto responsible because the defendant allegedly negligently manufactured and distributed Roundup with full knowledge that it was dangerous and defective and failed to provide adequate warnings and proper directions about the dangers associated with using it.

The plaintiff requests a trial by jury and seeks compensatory damages, with interest, costs for this action, attorneys’ fees and other relief this court deems proper. He is represented by Jacob A. Flint of Flint Law Firm LLC in Edwardsville, Illinois, and David J. Wool and Aimee H. Wagstaff of Andrus Wagstaff PC in Lakewood, Colorado.
