Cleaning subcontractor alleges breach of contract over Fairground Park renovation

ST. LOUIS — A cleaning subcontractor is suing Raineri Construction LLC, Fidelity and Deposit Co. of Maryland and the St. Louis Board of Public Service, alleging breach of contract.

Fresh Start Cleaning & Maintenance Inc. filed the complaint on Oct. 12 in the St. Louis Circuit Court against the defendants, alleging that they breached their duties of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on Dec. 19, 2016, Fresh Start Cleaning & Maintenance Inc. suffered financial injury from entering a subcontract with the defendants. The company was contracted to provide construction-related work for the Pool Locker Building project at Fairground Park, but the defendants failed to pay for the work and materials rendered by plaintiff, according to the complaint.

The plaintiff holds Raineri Construction LLC, Fidelity and Deposit Co. of Maryland and the St. Louis Board of Public Service responsible because the defendants allegedly failed to pay the amount owed under the contract and obligated the plaintiff to retain and pay for legal counsel to protect its interest.

The plaintiff requests a trial by jury and seeks judgment against defendants for the amount of $55,832, legal fees and costs, interest,and all other relief the court deems appropriate. The plaintiff is represented by Lawrence P. Kaplan of Kaplan Associates LLC in St. Louis.
