Owners blame broker, property manager for problems at St. Louis apartments

ST. LOUIS — The owners of a St. Louis apartment complex are suing the property manager and broker, citing alleged breach of property management agreement.

Cathedral View Apartments LLC and 3747 Dunnica Ave. LLC filed a complaint on Nov. 13 in the St. Louis Circuit Court against St. Louis Investor's Alliance and Kelly Jean Nelson, alleging that they failed to perform their obligations under the contract.

According to the complaint, the plaintiffs allege that, as a result of defendant's gross neglect of duty, plaintiffs suffered financial losses of more than $200,000, excluding property losses and non-property losses and other losses due to excessive vacancies. Their properties were also placed on a nuisance list by the city and were threatened with condemnation. 

The plaintiffs hold St. Louis Investor's Alliance and Kelly Jean Nelson responsible because the defendants allegedly charged monthly management fees on vacant units, failed to properly advertised vacant units, failed to implement eviction policies when tenants were not paying, and failed to regularly visit and properly maintain the property.

The plaintiffs request a trial by jury and seek judgment against the defendant sin excess of $25,000, together with interest, costs of suit, punitive damages, and such other relief that are just and proper. They are represented by Thomas R. Applewhite and Steven A. Donner of Donner Applewhite, Attorney at Law in St. Louis.
