Washington University, employee accused of negligence after cyclist allegedly hit by vehicle

ST. LOUIS — A cyclist is suing Don Moore and Washington University for allegedly taking insufficient measures to prevent injuries.

Linda Eggers filed a complaint on Jan. 23 in the St. Louis Circuit Court, alleging that Moore breached his duty to exercise the highest degree of care while operating a motorized vehicle.

According to the complaint, the plaintiff alleges that she was injured on Oct. 23, 2016 when the bicycle she was riding was allegedly struck by a motor vehicle driven by Moore, who was allegedly acting in the course and scope of his employment with Washington University at the time. She allegedly sustained serious injuries and pain and allegedly had to pay medical expenses. The plaintiff holds Moore responsible for allegedly operating the vehicle at a high and dangerous speed and for allegedly failing to stop or reduce speed before colliding with her.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount in excess of $25,000, court costs and such other relief that is proper. She is represented by James T. McMullin of James McMullin Attorney at Law in St. Louis.
