ST. LOUIS — A consumer has filed a class-action lawsuit against a local supermarket operator, citing alleged deceptive and unfair merchandising practices.
Connie Newman, individually and on behalf of all others similarly situated, filed a complaint on Jan. 30 in the St. Louis Circuit Court against Dierbergs Markets Inc., alleging that the supermarket operator violated the Missouri Merchandising Practices Act.
According to the complaint, the plaintiff alleges that, somtime in November or December 2017 she purchased the defendant's All Natural Chips for $2 because it was labeled that it only consisted of natural ingredients. However, she claims they contain xanthan gum, a synthetic, unnatural substance.
The plaintiff holds Dierbergs Markets responsible because the defendant allegedly falsely represented and advertised that its All Natural Chips did not contain any synthetic ingredients.
The plaintiff requests a trial by juryl and seeks an order certifying this case as a class action, appointing plaintiff as class representative and her counsel as class counsel, compensatory damages or disgorgement of ill-gotten gains, with interest, attorney fees, costs, and such other and further relief.
