Express Home Care, employee accused of negligence in woman's death

ST. LOUIS — A daughter is suing Express Home Care LLC and Diamond Davis, employer and employee, citing alleged negligence and wrongful death.

Yvonne Walls filed a complaint on Feb. 7 in the St. Louis 22nd Judicial Circuit Court against the defendants alleging that Davis failed to operate a vehicle in a careful and prudent manner.

According to the complaint, the plaintiff alleges that on July 22, 2016 her mother Katie M. Scott died in an automobile accident caused by the negligence of Davis who was driving a motor vehicle while in the course and scope of his employment with Express Home. Plaintiff suffered loss of society, service and companionship of her mother.

The plaintiff holds Express Home Care and Diamond Davis responsible because Davis allegedly negligently drove the vehicle at an excessive rate of speed, failed to keep proper lookout, and failed to yield the right of way.

The plaintiff requests a trial by jury; and seeks judgment against the defendants in a fair and reasonable amount exceeding $25,000, costs of court, interest, and all other relief that are just and proper. She is represented by Matthew J. Sauter of Sauter Sullivan LLC in St. Louis.
