Progressive Advanced Insurance accuses driver of failing to take safety measures to avoid car accident

ST. LOUIS — An insurance company is suing Jay Mullins, a driver, for allegedly taking insufficient measures to prevent injuries.

Progressive Advanced Insurance filed a complaint on Feb. 9 in the St. Louis Circuit Court, alleging that the defendant breached his duty to exercise due care while operating a motor vehicle.

According to the complaint, the plaintiff alleges that its insured vehicle was involved in a accident on Oct. 18, 2015. The plaintiff allegedly paid the insured for injuries and damages, but the sum of $54,651.05 allegedly remains due. The plaintiff holds the defendant responsible for allegedly failing to operate his motor vehicle in a safe manner and for allegedly refusing to pay the said amounts.

The plaintiff requests a trial by jury and seeks judgment against the defendant for $54,651.05, interest, costs and any other relief that is proper under the circumstances. The plaintiff is represented by Piper Lori Hughes of Wetsch Abbott Osborn Van Vliet PLC in Des Moines, Iowa.
