Woman claims noisy upstairs neighbors are a nuisance

ST. LOUIS — A condo owner is suing her neighbors, alleging continuing nuisance.

Elena Schafer filed a complaint on Feb. 16 in the St, Louis Circuit Court against Brian Witkin, Vanessa Woods and Adam Weygandt, alleging that they intentionally impair her right to peaceful and quiet enjoyment of her home. 

According to the complaint, the plaintiff alleges that since October 2017 the defendants, who live above her  at 4440 Olive St. in St. Louis, have repeatedly jumped, run and stomped during unreasonable periods of the day and night. As a result, Schafer claims she has suffered a decline in the usable value of her property, pain and suffering, and inconvenience. 

The plaintiff requests a trial by jury; and seeks judgment against the defendants in an amount greater the $25,000, costs, attorney fees, and all other appropriate relief that is just and proper. She is represented by Ben Aranda of The Aranda Law Firm PC in St. Louis.
