ST. LOUIS — A personal care company is suing Fusion Lab LLC and Kevin Tibbs, cosmetic product developers, citing alleged intentional misrepresentation, conversion and unjust enrichment.
L. Park LLC filed a complaint on March 6 in the St. Louis Circuit Court against the defendants alleging that they violated the Missouri Uniform Trade Secrets Act.
According to the complaint, the plaintiff alleges that in 2015 the plaintiff hired the defendants and paid approximately $175,385 to develop certain intellectual property (IP) products that would be owned by the plaintiff. However, the defendants allegedly refused to confirm the plaintiff's ownership of the IP products and overbilled for unneeded raw materials.
As a result of the defendants' conduct, the plaintiff allegedly suffered damages for not having ownership of the IP products and approximately $30,000 to $50,000 in funds.
The plaintiff requests a trial by jury; and seeks an order declaring the plaintiff is the sole owner of the IP products, damages exceeding $25,000, attorney's fees, costs, and all other additional relief that is just and proper. It is represented by Henry P. Elster of Bick & Kistner in St. Louis.
