ST. LOUIS – A man alleges an insurance company has failed to pay him benefits under his late brother's life insurance and accidental death policy.
Benny Mandina filed a complaint on March 13 in the St. Louis 22nd Judicial Circuit Court against Globe Life and Accident Insurance Co. alleging breach of contract and vexatious refusal to pay.
According to the complaint, the plaintiff alleges that on Aug. 8, 2015, his brother Charles Mandina died when he slipped on a wet floor while getting out of the shower and struck his head. As a beneficiary, the plaintiff alleges he is entitled to receive his brother's life insurance benefits of $20,000 and accidental death insurance benefits of $25,000.
The plaintiff holds Globe Life and Accident Insurance Co. responsible because the defendant allegedly failed and refused to make payments to plaintiff under the insurance contract.
The plaintiff seeks judgment against the defendant in an amount not to exceed $75,000 with interest, costs and all other relief that is proper and just. He is represented by Matthew J. Sauter of Sauter Sullivan LLC in St. Louis.
