Former Flance Early Learning Center student seeks approval of settlement over head injuries

ST. LOUIS – A former student at a St. Louis early learning center alleges he was injured when another child pushed him off of a scooter.

Carter Hart, a minor by his natural mother and next friend, Adrienne Hart, filed a complaint on March 8 in the St. Louis 22nd Judicial Circuit Court against Flance Management Inc., doing business as Flance Early Learning Center, alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 18, 2017, he was a student at Flance Early Learning Center and was playing on a scooter. The suit states he was pushed by another child off the scooter, causing a concussion and a hematoma on his forehead.

The plaintiff holds Flance Management Inc. responsible because the defendant allegedly failed to supervise the activities of the children and failed to provide head protection for the plaintiff.

The suit states the parties have negotiated a settlement for the amount of $20,000 and are seeking approval of the settlement.

The plaintiff seeks an order that the settlement is fair and reasonable. He is represented by Kirk J. Wittner of STL Law Group LLC in St. Louis.
