ST. LOUIS – A woman alleges she was injured in a motorcycle accident and that her insurer has wrongfully refused to pay her uninsured motorist benefits.
Jenna English filed a complaint on March 23 in the St. Louis Circuit Court against Progressive Casualty Insurance Co. alleging that the licensed insurer breached the covenant of good faith and fair dealing.
According to the complaint, the plaintiff alleges that on June 18, 2016, she was a passenger on a motorcycle and she was injured in an accident caused by an abrupt lane change by an unknown motorist. At the time of the accident, she alleges she was covered under the uninsured motorist policy issued by the defendant.
On Nov. 30, 2016, the suit states the plaintiff made a demand for uninsured motorist benefits from defendant and that the defendant has failed and refused to make payment.
The plaintiff holds Progressive Casualty Insurance Co. responsible because the defendant's refusal to pay is allegedly without a cause.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount of more than $25,000 but not more than $75,000, with interest, costs, attorneys' fees and all other just and proper relief.
