Consumer seeks $100,000 in coverage from Stillwater Insurance Co. over injuries

ST. LOUIS – A Jefferson County woman alleges her insurer wrongfully refused her claim for underinsured motorist benefits.

Michelle L. Nunnally filed a complaint on April 3 in the St. Louis Circuit Court against Stillwater Insurance Co. alleging vexatious refusal contract.

According to the complaint, the plaintiff alleges that on Oct. 5, 2012, she was injured as a result of the carelessness of an underinsured driver in a collision on Interstate 270 in St. Louis. She alleges she suffered injuries and damages in excess of the at-fault driver's insurance coverage. The plaintiff had made demand upon defendant for underinsured motorist coverage of $100,000. 

The plaintiff holds Stillwater Insurance Co. responsible because the defendant allegedly failed and refused to settle plaintiff's demand for underinsured motorist benefits.

The plaintiff seeks judgment against the defendant for vexatious refusal, attorney' fees, costs and all other additional relief as the court may deem appropriate. She is represented by Andrew B. Klein of Kullmann, Klein & Dioneda PC in St. Louis.
