3453 Juniata LLC alleges property is at risk of collapse because of construction work

ST. LOUIS – The owner of a St. Louis property alleges the property is at risk of imminent collapse because of construction on a neighboring lot.

3453 Juniata LLC filed a complaint on April 3 in the St. Louis 22nd Judicial Circuit Court against Urban Improvement Construction LLC and Botanical Heights Homes LLC alleging trespass and negligence.

According to the complaint, the plaintiff owns a property on Juniata Street in St. Louis and that the Urban Improvement Construction has been working on construction projects at lots adjacent to the plaintiff's property that are owned by Botanical Heights Homes.

The plaintiff alleges that the removal of the lateral support on a neighboring lot to its property caused the collapse of a fence and sidewalk and has placed the plaintiff's property at imminent risk of collapse.

The plaintiff holds Urban Improvement Construction LLC and Botanical Heights Homes LLC responsible because the defendants allegedly failed to perform construction work in a professional and safe manner to prevent damages to plaintiff's property.

The plaintiff seeks judgment against the defendants, jointly and severally for $17,042 in loss profits, together with damages to the property, punitive damages, costs and attorney's fees. It is represented by Jonathan P. Beck of Beck Ostrom Sweet LLC in St. Louis.
