Woman alleges The Daniel & Henry Co. failed to obtain type of insurance requested

ST. LOUIS – A woman has filed suit against insurance brokers after her claim for underinsured motorist benefits was denied.

Katherine Sheridan filed a complaint on April 17 in the St. Louis Circuit Court against The Daniel & Henry Co., Leo P. Cremins and Wendy Weakley alleging negligence, breach of contract and misrepresentation.

According to the complaint, the plaintiff alleges that due to the injuries and damages she suffered on June 5, 2009, when she was struck by an underinsured driver while riding a bicycle in South Carolina, she filed a claim for underinsured motorist coverage to the Midwestern Indemnity Co. personal auto coverage policy, which was brokered and sold by defendants to plaintiff's mother. The suit states her claim was denied because the policy did not include coverage of the plaintiff.

The plaintiff holds The Daniel & Henry Co., Cremins and Weakley responsible because the insurer denied coverage for her claim because the defendants allegedly failed to obtain the type of insurance requested by her mother.

The plaintiff seeks judgment against the defendants, jointly and severally, for damages of more than $25,000, with interest and costs of suit. She is represented by Alan S. Mandel and Michael J. Sudekum of Mandel & Mandel LLP in St. Louis.
