Driver alleges he is owed damages under Safeco Insurance Co. of Illinois policy

ST. LOUIS – A driver alleges he is entitled to uninsured motorist coverage under his insurance policy and that his insurer has failed to pay damages.

Delovan Zewki filed a complaint on April 23 in the St. Louis Circuit Court against Safeco Insurance Co. of Illinois alleging that the licensed insurer failed to perform its contractual obligations.

According to the complaint, the plaintiff alleges that on Nov. 23, 2017, he was injured in a motor vehicle collision negligently caused by an unknown driver who fled the scene of the collision. He alleges he suffered injuries that are permanent and progressive in nature as a result of the collision. The suit states that at the time of the collision, the vehicle used by plaintiff was covered by the insurance policy issued by the defendant.

The plaintiff holds Safeco Insurance Co. of Illinois responsible because the defendant allegedly failed and refused to pay plaintiff's damages under the uninsured motorist provision of the insurance policy.

The plaintiff requests a trial by jury and seeks judgment against the defendant of more than $75,000, costs of court and such other relief that are appropriate under the circumstances. He is represented by Scott L. Kolker of Defeo & Kolker LLC in Clayton.
