Man alleges business partner failed to pay share of profit after St. Louis house was sold

ST. LOUIS – A St. Louis man alleges he did not receive his share of a profit after a house was sold.

Thomas M. Gallagher filed a complaint on May 1 in the St. Louis Circuit Court against Nicholas Walsh alleging breach of contract, fraud and quantum meruit.

According to the complaint, the plaintiff alleges that on Aug. 31, 2009, the parties agreed to purchase a two-story flat at 4918 Berthold Avenue for the purpose of rehabbing and reselling it for profit. The house was sold in 2007 for approximately $200,000. The plaintiff alleges he has been damaged because he did not receive his 50 percent portion of the profit as agreed upon. 

The plaintiff holds Walsh responsible because the defendant allegedly refused to pay his share and left town without fulfilling his promise.

The plaintiff seeks actual and punitive damages of more than $25,000, costs of court and all further relief that is just under the premises. He is represented by Gregory M. Gantz of The Gantz Law Firm LLC in Chesterfield.
