Pedestrian alleges hole in St. Louis sidewalk caused broken leg

Medical malpractice 07

ST. LOUIS – A pedestrian alleges the city of St. Louis' failure to repair a hole in a sidewalk caused him to break his leg.

Fabian Miller filed a complaint on May 22 in the St. Louis Circuit Court against the city of St. Louis alleging negligence.

According to the complaint, the plaintiff alleges that on May 4, he was a pedestrian on a public sidewalk in front of 4641 Sacramento in St. Louis when his right foot and leg got caught in a large hole in the sidewalk. He alleges he suffered a broken leg and lower extremity as a result.

The plaintiff holds the city of St. Louis responsible because the defendant allegedly allowed the walkway to remain in a dangerous condition.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount of more than $25,000, prejudgment interest, cost and all other relief that are necessary and proper. He is represented by Benjamin J. Sansone of Sansone Sumner & Lauber in St. Louis.
