Tenant alleges bannister at Condominium Property Management location came loose, caused fall

ST. LOUIS – A tenant alleges she fell at her rental property because her landlord failed to correct the defective condition of the bannister.

Charlotte Caldwell filed a complaint on May 31 in the St. Louis 22nd Judicial Circuit Court against Condominium Property Management Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 8, 2013, she was a tenant of the defendant at a Maffitt Avenue property and was injured when she fell while descending the stairs because the bannister came loose. She alleges she suffered injuries to her right knee, right hand, right shoulder and back and incurred damages of more than $25,000 as a result of the incident. 

The plaintiff holds Condominium Property Management Inc. responsible because the defendant allegedly failed to remedy the bannister's defective condition and failed to warn her of the dangerous condition.

The plaintiff seeks judgment against the defendant in a fair and reasonable amount of more than $25,000, plus costs and all other relief that is proper and just. She is represented by Kyle Kleefus of Law Offices of Derald L. Gab PC in St. Louis.
