Insured motorcycle rider alleges GEICO failed to pay claim for collision with uninsured motorist

ST. LOUIS – A St. Louis man alleges he was injured in a collision with an uninsured motorist and that his insurer has failed to pay his claim.

Eric DeFord filed a complaint on May 30 in the St. Louis 22nd Judicial Circuit Court against GEICO Indemnity Co. and James Fohey alleging breach of contract and vexatious refusal to pay.

According to the complaint, the plaintiff alleges that on Sept. 15, 2014, he was on his motorcycle and stopped at a stop sign at the intersection of Sidney Street and Tennessee Avenue in St. Louis when Fohey struck him from behind. The plaintiff alleges he was injured in the collision and the motorcycle was damaged.

The suit states that at the time of the accident, the plaintiff was insured by the defendant and made a demand for it to pay an amount within the limits of the uninsured motorist coverage. 

The plaintiff holds GEICO Indemnity Co. and Fohey responsible because defendant GEICO allegedly vexatiously refused to pay the plaintiff's damage claim of $125,000 and Fohey drove at an excessive speed for the conditions.

The plaintiff seeks judgment against the defendants in an amount exceeding $25,000, plus costs of court and all further relief that is just and appropriate. He is represented by Timothy J. Gallagher and Candace A. Weatherfield of Gallagher Davis LLP in St. Louis.
