ST. LOUIS – An insured motorist injured in a crash involving a phantom driver alleges that his insurer has failed to pay him the fair value of his claim.

Lionel Thompson filed a complaint on June 4 in the St. Louis Circuit Court against Young America Insurance Co. alleging breach of contract and vexatious refusal to pay.

According to the complaint, the plaintiff alleges that on June 15, 2016, he was involved in a motor vehicle collision negligently caused by a phantom driver at the intersection of Arkansas Avenue and Wyoming Avenue. He alleges he sustained serious and permanent injuries to his head and low back and incurred medical expenses in excess of $3,724 as a result of the accident. At the time of the accident, the suit states he was covered by the uninsured motorist policy issued by defendant.

The plaintiff holds Young America Insurance Co. responsible because the defendant allegedly refused to pay him the fair value of his claim.

The plaintiff seeks judgment against the defendant in an amount of more than $25,000 but less than $75,000, plus costs of court. He is represented by Thomas Traube of Sorrell & Traube in St. Louis.
