Injured driver, passenger allege Allstate has refused to pay amount under unisured motorist policy

ST. LOUIS – Two individuals injured in an auto accident in St. Louis allege their insurer has refused to pay them benefits they are entitled to under the driver's policy.

Aldo Reinoso and Carlos Peraza filed a complaint on June 4 in the St. Louis Circuit Court against Allstate Fire and Casualty Insurance Co. alleging vexatious refusal and breach of contract.

According to the complaint, the plaintiffs allege that on Nov. 3, 2017, Reinoso and Peraza were injured in an auto accident due to the carelessness of an uninsured motorist at the intersection of Washington Avenue and Fourth Street in St. Louis. They allege they sustained severe, permanent and progressive injuries as a result of the accident.

The plaintiffs allege they made a demand for the defendant to pay the amount within the limits of the uninsured motorist coverage under the policy Reinoso has with the defendant, but the defendant has failed a refused to make a payment as required under the policy.

The plaintiffs seek judgment in favor of each plaintiff in and amount greater than $25,000, plus costs and all other relief that are just and reasonable. They are represented by Benjamin J. Sansone of Sansone Sumner & Lauber in Clayton.
